  • Internet Victim Seeks "Death Penalty" for Online Scam

    The Federal Trade Commission, San Bernardino District Attorney's Office, United States Postal Inspector, and the LA County Bureau of Consumer Affairs have launched into an investigation of A.V.I. Data Processing Center, who is being accused of fraudulently selling a Work-At-Home offer on the Internet. The investigation is based on a complaint filed by Robert Brady, a consumer, and Reagan Lynch of First Consumer AVI could face charges of using unlawfully deceptive classified ads and the Internet to sell their Judgement Recovery Operations Program, in violation of both State & Federal laws.

    Better Business Bureau records confirm that there have been 117 complaints filed across the United States against AVI ( in the past two years. In spite of these complaints, they still continue to use the same ads and website.

    Brady and Lynch accuse AVI Data Processing Center, located in Highland, Ca., of intentionally misleading consumers into believing that AVI wants to employ home-based data entry workers and can earn a potential income of $2000-$4000 a month. All that is required is a good faith deposit of $175 to "show your sincerity." "Team members" are promised a full refund if "you complete 50 client assignments in 60 days. One assignment should take less than an hour to complete." What the consumer receives is an out-dated, 20 page brochure, and a floppy disc, that tell the consumer to start their own home based business.

    Brady had applied for the program. "After seeing their ad and visiting their website," he states, "I knew I wouldn't make $2000 a month, but I felt this could be a perfect way to make the payments on the student loan I need to attend a computer college full-time. I'm really upset because now I have to delay my plans. When I found out what they are doing could be illegal, I contacted Reagan and informed the District Attorney's office, the FTC, and several other agencies through online complaint forms"


    Lynch, a Consumer Advocate who is representing Brady, states, "Companies like AVI prey on unsuspecting people that are looking for a way to create an income at home, especially stay-at-home Moms, and then end up as victims. AVI 's classified ads appeared in 22 states across the country and on websites all over the Internet. They need to be shut down, or forced to disclose on their website that this is not an employment offer!"

    Lynch and Brady, attempting to get Brady¹s money back, had contacted Dameon Higgins, the owner on record of AVI Data Processing Center, and parent company (a.k.a. Nationwide Collection Services). Higgins denied any personal connection with AVI, stating that AVI was only a client of his firm, RDH & Associates.

    No records have been found to show Higgins' firm, RDH & Associates, ever existed. Searches of fictitious business name filings show Higgins as the sole owner of AVI. Records also show that Higgins has used several aliases when filing for licenses and permits. Neither are there records showing that a Business Opportunity Disclosure was ever filed, which is required by state law, with the California Department of Consumer Affairs.

    If prosecuted, Higgins could face several years in prison on multiple counts, stiff fines and penalties, and ordered to return thousands of dollars to consumers.
